These Terms & Conditions (“Terms”) govern access to and use of BuyTestCup.com and purchases made from Buy Test Cup through our Website, telephone, email, quotation, invoice, purchase order, wholesale account, reseller account, private-label program, or another sales channel operated by Buy Test Cup.
By accessing the Website, creating an account, submitting an order, approving a quotation or invoice, submitting a purchase order, approving artwork or product specifications, or purchasing, distributing, reselling, or using products supplied by Buy Test Cup, you acknowledge that you have read, understand, and agree to these Terms.
If you do not agree with these Terms, please do not use BuyTestCup.com or purchase products from Buy Test Cup.
1. PRODUCTS AND PRODUCT INFORMATION

2. CUSTOMER RESPONSIBILITY
The customer is responsible for determining whether a particular product is appropriate and lawful for the customer’s:

The fact that a product is available for purchase on BuyTestCup.com does not mean that the product may lawfully or appropriately be used for every purpose, by every person, or in every jurisdiction.
Organizations performing workplace, forensic, correctional, court, insurance, clinical, federally regulated, or other specialized testing are responsible for understanding and complying with all applicable laws, regulations, policies, and testing-program requirements.

4. ORDERS AND ORDER ACCEPTANCE

Customers purchasing under approved credit terms must pay invoices according to the applicable invoice or written credit agreement.
Past-due accounts may be placed on credit hold.

7. TAXES
Customers are responsible for applicable:

Customers claiming tax-exempt or reseller status are responsible for providing and maintaining accurate and valid documentation.
8. SHIPPING AND DELIVERY
Shipping and delivery dates are estimates unless Buy Test Cup specifically guarantees a delivery commitment in writing.
We are not responsible for delays caused by shipping carriers or circumstances reasonably outside our control after an order has been properly tendered for shipment, except as otherwise required by applicable law.
Customers are responsible for providing complete and accurate shipping information.
Additional carrier charges caused by circumstances such as:
- Incorrect addresses
- Address corrections
- Refused deliveries
- Redelivery
- Storage
- Residential delivery
- Limited-access delivery
- Lift-gate requirements
- Inside delivery
- Other special carrier services
may be charged to the customer where applicable.
9. INSPECTION OF SHIPMENTS
Customers should inspect shipments promptly after delivery.
Please notify Buy Test Cup promptly regarding:
- Shipping damage
- Missing merchandise
- Incorrect merchandise
- Quantity shortages
- Product defects
- Other shipment discrepancies
Claims involving damaged or allegedly defective merchandise should ordinarily be reported within 5 business days of delivery whenever reasonably possible.

Customers should retain affected merchandise and packaging until the matter has been resolved.
10. 30-DAY RETURN POLICY
Eligible standard merchandise may be returned within 30 days of receipt, subject to the applicable Return & Refund Policy and these Terms.
Eligible returned merchandise must generally be:
- Unused
- Unopened
- Undamaged
- Unaltered
- Unexpired
- In original packaging
- In resalable condition
All original seals, packaging, instructions, accessories, and components must accompany the return.
A Return Merchandise Authorization or other approval from Buy Test Cup may be required before merchandise is shipped back.
Receipt of returned merchandise does not automatically constitute acceptance of the return.
All returned merchandise is subject to inspection.
15% RESTOCKING FEE
Approved returns of correctly supplied standard merchandise are subject to a 15% restocking fee.
The restocking fee will be deducted from the amount otherwise eligible for refund.
NON-REFUNDABLE SHIPPING
Original shipping, freight, handling, expedited-delivery, and similar transportation charges are generally non-refundable.
An exception may apply where the return resulted solely from a verified Buy Test Cup error or where otherwise required by applicable law.
Customers returning merchandise because it is no longer wanted or needed are responsible for return shipping.
Returns should be shipped using an insured and traceable method.
Buy Test Cup is not responsible for merchandise lost or damaged during customer-arranged return transportation.
REFUND CALCULATION
An approved standard return will ordinarily be calculated as:

Refunds will generally be issued to the original payment method.
11. PRODUCTS SHIPPED IN ERROR
If Buy Test Cup ships merchandise different from what was ordered, please notify us promptly.
After verification, Buy Test Cup may provide:

- Return authorization
- Account credit
- Store credit
- Refund
When a return is necessary solely because of a verified Buy Test Cup fulfillment error:
- The 15% restocking fee will not apply; and
- Authorized standard return-shipping costs will be covered by Buy Test Cup.
12. DEFECTIVE PRODUCTS
Customers who believe a product is defective should discontinue use of the affected merchandise and contact Buy Test Cup promptly.
We may request:

- Lot number
- Expiration date
- Photographs
- Quantity affected
- Storage information
- Testing procedure
- Description of the problem
Customers should not destroy or discard merchandise involved in a product-quality complaint unless instructed to do so.
If a product is verified to have been defective when supplied, Buy Test Cup may provide an appropriate:
- Replacement
- Credit
- Refund
The 15% restocking fee does not apply to merchandise verified to have been defective when supplied.
13. NON-RETURNABLE PRODUCTS
Unless otherwise required by applicable law or specifically approved in writing, non-returnable merchandise may include:

- Used products
- Products with broken or removed seals
- Expired merchandise
- Products improperly stored after delivery
- Products damaged after delivery
- Products returned outside the return period

- OEM merchandise
- Customer-specific packaging
- Customer-specific labels
- Customer-branded products
- Products manufactured or procured specifically for a customer
Because drug-testing and diagnostic products may be affected by storage, contamination, temperature, packaging integrity, and handling, Buy Test Cup may refuse returns where product integrity or suitability for resale cannot reasonably be verified.
14. WHOLESALE, DISTRIBUTOR AND RESELLER ORDERS
Wholesale customers, distributors, resellers, dropship customers, pallet purchasers, and other commercial customers are subject to these Terms unless a separate written agreement states otherwise.
Eligible non-custom wholesale merchandise may be returned under the applicable 30-day return policy and is generally subject to:
- A 15% restocking fee
- Non-refundable original shipping and freight
Truckload orders, container orders, pallet orders, production runs, very large-volume purchases, or specially negotiated transactions may contain different terms stated in a:

- Contract
- Invoice
- Purchase-order acknowledgment
- Distributor agreement
- Wholesale agreement
- Other written agreement
Specific accepted written terms take precedence over conflicting general provisions for that transaction.
15. PRIVATE-LABEL, OEM AND CUSTOM PRODUCTS
Private-label, OEM, customer-branded, custom-configured, specially manufactured, and special-order merchandise is generally:
FINAL SALE AND NON-RETURNABLE.
Customers are responsible for reviewing and approving all applicable:
- Artwork
- Logos
- Product names
- Spelling
- Branding
- Drug-panel configurations
- Cutoff concentrations
- Product specifications
- Labels
- Packaging
- Quantities
- Regulatory statements
- Proofs
Once specifications or artwork have been approved and manufacturing or procurement has begun, the order generally cannot be:
- Canceled
- Returned
- Refunded
- Exchanged
Customer approval constitutes authorization for Buy Test Cup and/or its manufacturing partners to manufacture, label, package, or procure merchandise according to the approved specifications.
16. ORDER CANCELLATIONS
Standard orders may be canceled before fulfillment only when approved by Buy Test Cup.
An order that has entered warehouse processing, fulfillment, or shipment may no longer be cancelable.
Private-label, custom, OEM, and special-order merchandise generally cannot be canceled once production or procurement has commenced.
17. INTERNATIONAL ORDERS

International customers are responsible for confirming that the products ordered may lawfully be:

- Import taxes
- Brokerage fees
- Registrations
- Licenses
- Permits
unless otherwise agreed to in writing.
18. RAPID DRUG TESTS ARE SCREENING DEVICES
Unless the specific manufacturer’s labeling states otherwise, rapid drug-testing products provide screening results.
A result described as:
- Preliminary positive
- Presumptive positive
- Non-negative
- Reactive
should not automatically be considered a definitive laboratory-confirmed result.
Where confirmation is required by law, regulation, employer policy, court procedure, correctional program, professional practice, or other applicable requirements, an appropriate laboratory confirmation methodology should be used.
Customers remain responsible for their testing program, including where applicable:
- Specimen collection
- Chain-of-custody procedures
- Laboratory confirmation
- Medical Review Officer review
- Recordkeeping
- Confidentiality
- Reporting
- Result management
19. TEST PERFORMANCE AND TEST RESULTS
Drug-test performance and results can be affected by numerous factors, including:
- Improper collection
- Improper timing
- Specimen adulteration
- Storage
- Temperature
- Expiration
- User error
- Cross-reactivity
- Certain medications
- Cutoff concentrations
- Specimen characteristics
- Failure to follow instructions
Customers must follow the applicable manufacturer’s:
- Instructions for Use
- Package insert
- Warnings
- Timing requirements
- Storage requirements
- Result-interpretation requirements
- Limitations
Buy Test Cup does not make medical, treatment, employment, legal, probation, parole, insurance, or similar decisions for customers.
The applicable employer, agency, healthcare professional, laboratory, Medical Review Officer, legal authority, or other responsible decision-maker remains responsible for such determinations.
20. FORENSIC USE ONLY AND EMPLOYMENT & INSURANCE PRODUCTS

- Other federal agencies
are responsible for complying with the specific requirements applicable to those programs.
These requirements may involve:

- Reporting requirements
SPECIALTY ANALYTES

Information provided by Buy Test Cup does not constitute individualized:

22. COMPLIANCE WITH LAW

26. WARRANTIES
